CITY OF NEW BRIGHTON
REQUEST FOR COUNCIL CONSIDERATION
Agenda Section: V I I - 5
Report Number: 8 2 - 3 21
Report Date: Docember 22, .1982
ITEM DESCRIPTION: APPLICATION FOR VARIANCE & SITE PLAN APPROVAL
VN-225, LP-136 & LP-138, CITY OF NEW BRIGHTON
DEPT. HEAD'S APPROVAL: ~ L L ~~--"~
MANAGER'S REVIEW/RECOMMENDATION:
No comments to supplement this report ~ ~ Comments below/attached
EXPLANATION/SUMMARY (attach supplemental sheets as necessary):
SUMMARY
APPLICANT: City of New Brighton
LOCATION: Well #10 - South of Jones Lake
Well #1r1 - 7th Street NW & Hansen Park
ZONING: We11 #10 - I-i, Light Industrial
Well #11 - R-1, Single Family Residential
1. Well #10 - To construct a building to house the well and iron removal equipment. The
reason for the variance request is that the zoning code requires a 60 foot setback
. from residential districts and the building is only 50 feet from the west property
line. The unique circumstance is that the City has to construct this new well in
response to the water contamination problem. The undue hardship facing the City is
that the Minnesota Health Department will only approve this location because of
State distance requirements from the water tower and underground storm sewer pipes.
To meet zoning code requirements the City would be forced to select another site or
purchase additional property which would be an undue hardship. The impact of the 10
foot variance request is lessened because the west property line of the adjance
property consists of a row of garage bui]dings for the apartment complex. The 10
foot variance will not have a negative visual impact nor create any safety problems
for adjoining residents.
2. Well #11 - To construct a structure off of 7th Street NW on City owned property
adjacent. to Hansen Park to house Well #11 and the iron removal equipment.. The
construction is a part of the solution to the City's water contamination problem..
RECOMMENDATION
To waive the reading and adopt the attached Resolution approving VN-225; and
To approve by simple motion LP-136 and LP-138 subject to the following:
1. That final plans be approved by Rice Creek Watershed District and City Engineer;
2. That there is conformance with site and landscape plans.
v
J M. Archer, City Planner
