1--/ <br />RESOLUTION NO 83-112 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING-VARIANCE., <br />VN-227 <br />WHEREAS, an application for VN-227 has been made by Mateffy <br />Engineering to construct a garage with a less than required <br />setback; and <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a variance VN-227 was filed with <br />the City on September 5, 1983. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on September 20, <br />1983, all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on September 27, 1983. <br />4. The written comments and analysis of the City Staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-227: <br />1. That the property is zoned B-3, General Business. <br />2. That the placement of the garage on any other location <br />on the site would severly limit use of the applicant's <br />property. <br />3. Thatnot having a garage would create undue hardship on <br />the applicant. <br />4. That the proposed garage will have a 10 foot setback and <br />there is a 20 foot sewer easement on the adjacent <br />property. <br />5. That the variance will not adversely affect any adjacent <br />properties. <br />BE IT FURTHER RESOLVED that the application is and hereby <br />recommended for approval. <br />Adopted this 27thday of September 1983. <br />A 4?? <br />Gergor B. arcus, Mayor <br />ATTEST <br />s F.
