RESOLUTION NO 83--112 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON M C W6 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-227 WHEREAS, an application for VN-227 has been made by Mateffy Engineering for property described as: The South 120 feet of the North 502.5 feet of the East 200 feet of that part of the Southwest 4 of the Northeast a of Section 29, Township 30, Range 23, lying West railroad right-i of-way line of the Minnesota Belt Line Railway, and also the East 200 feet of all that part of the Southwest J of the Northeast a of said section lying West of the West right - of- way line of the Minnesota Belt Line Railway, except the North! 502.5 feet thereof and except the South 700 feet thereof, together with an easement for ingress and egress thereto and therefrom over and across the Northerly 10 feet of the Easterly 145 feet of all that part of the Southwest 4 of the Northeast $ of said section lying Southeasterly of State Trunk Highway No. 8 and Westerly of the West right-of-way line of the Minnesota Belt Line Railway, except the East ! 200 feet thereof; to construct a garage with a less than required setback; and ?f WHEREAS, the procedural history of the application is as i; follows: I 1. That an application for a variance VN-227 was filed with the City on September 5, 1983. 2. That the Tlanning Commission, pursuant to published a.nd mailed notices, held a public hearing on September 20, 1983, all persons present at the hearing were given an opportunity to be heard. 3. That such application was reviewed by the City Council i on September 27, 1983. 4. The written comments and analysis of the City staff, the Planning Commission minutes and recommendations were considered. ! NOW THEREFORE BE IT RESOLVED by the City Council that the (following Findings of Fact are made in respect to VN-227: 1. That the property is zoned B-3, General Business. 2. That the placement of the garage on any other location on the site would severly limit use of the applicant's property. 3. That not having a garage would create undue hardship on the applicant. 4. That the proposed garage will have a 10 foot setback and there is a 20 foot sewer easement on the adjacent property. 5. That the variance will not adversely affect any adjacent properties.
