RESOLUTION NO <br />NEW BRIGHTON PLANNING COMMISSION <br />~; <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMEN4ING DENIAL OF <br />'' VARIANCE VN-234 <br />WHEREAS., an application for VN-234 has been made by Remingto <br />Builders for th.e property described as: <br />Lot 5, Block 1, Innsbruck North Silver Lake Addition, <br />Ramsey County, Minnesota; and <br />WHEREAS, The procedural history of the application is as <br />follows: <br />1. That an application for a variance VN-234 was filed with <br />the City on June 4, 1984. <br />2. That the Planning Commission, pursuant to published .and <br />mailed notices, held a public hearing on June l9, 1984,, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />NOW THEREFORE BE IT RESOLVED by the .Planning Commission tha <br />the following Findings of Fact are made in respect to VN-234; <br />1. That the property is zoned R-1, Single Family Residential <br />Z. That the required front yard and side street yard setback <br />are 30 feet; <br />3. That a variance request (VN-231) was previously approved <br />for a 10 foot side street yard variance on the cul-de-sa <br />4. That the applicant has now requested a 16 foot variance <br />on the cul-de-sac; <br />5. That the applicant was made aware of the building setbac <br />violation prior to the laying of the foundation; <br />6. That the proposed entryway is part of the building <br />structure and therefore subject to the building setback <br />requirements; <br />7. That the building structure can be built without the. <br />additional 6 foot variance; and <br />8. That any financial loss due to the change in the propose <br />entryway does not constitute undue hardship. <br />BE Is FURTHER RESOLVED that the application VN-234 is and <br />hereby recommended for denial. <br />Adopted this 19th day of May, 1984. <br />Roger S.
