e <br />----~--A RESOLUTION N0.84-20 <br />NEW BRIGHTON PLANNING COMMISSION <br />RESOLUTION MAKING FIN-DINGS OF FACT AND RECOMMENDING ;4PPRO~VAL,~OF <br />VARIANCE VN-231. <br />W~'EREAS, an applicatian for VN-23l has been made by <br />Remington Builders to allow less than the required .front yard <br />setback; <br />.WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application fora variance VN-231 was filed <br />with the City on March 6, 1984. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on March 20, <br />1984, and all persons present at the hearing were given <br />an opportunity to be heard. <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission .that <br />the following Findings of Fact are made in respect to VN-231: <br />1. That the property is zoned R-1, Single <br />Family Residential; <br />2. That the required-front yard and side street <br />yard setbacks in R-1 zoning deistricts is 30 feet; <br />3. That the area may have been platted with a misunder- <br />standing on the setback requirements on the cul-de-sac. <br />4. That the configuration of the cul-de-sac is A-symetrical <br />and is not similar to other cul-de-sacs in the City. <br />5. That there are only three points of the proposed dwell- <br />ing that protrude into the setback area.8 and 10 feet. <br />6. That the- proposed home is of comparable size and value <br />of the surrounding area. <br />7. That the applicant has demonstrated unique and unusual <br />circumstances and undue hardship for the variance. <br />BE IT FURTHER RESOLVED, that the application for VNT231 is <br />and hereby recommended for approwai. <br />Adopted this 28th day of March, <br />Brenda A.
