The garage which was damaged was a Type <br />IV non-conformity, i.e. it did not meet the required property line <br />setbacks. The building setbacks in a R-1, Single Family Residential <br />zoning are 30 feet from the front property line and 5 feet from the <br />side property line. The garage which was damaged was 14 feet off <br />the front yard property line and 2 feet off the side yard property <br />line. Repairs of a Type IV non-conformity are not permitted if the <br />cost of repair exceeds 50 percent of the current assessor's market <br />value (Section 8-380), <br />To rebuild the garage you applied fora variance with the City of <br />New Brighton. Your variance request was for a double car garage <br />with a 13 foot front yard setback. 'The new garage would meet the <br />required side yard setbacks. To apply for the variance you were <br />required to submit certain information which included a current <br />property survey, an abstractors certificate listing all the property <br />owners within 350 feet of the property at 1681 -.14th Avenue NW and <br />an application form and $50.00 fee. In this case the variance. <br />request was necessary since there was no way in which a double car <br />garage could be built on the property within the required property <br />line setbacks. In addition your proposed layout of the new garage <br />and driveway was very functional and a great improvement to the <br />property.
