July 27, 1984 <br />~- VN-237 <br />TOM THUMB SIGN <br />PURPOSE <br />To consider a request for a variance to construct a sign. <br />BACKGROUND <br />.APPLICANT: Tom Thumb Stores <br />Representative: Dan Kaufman <br />.Kaufman Sign Company <br />LOCATION:- 375 Silver Lake Road <br />ZONING: B-2, Neighborhood Business <br />VARIANCE REQUEST: To install a sign pinned away .from <br />the wall more than 18 inches <br />(Section. 9-130 d.) <br />CODE REQUIREMENTS: Section 9-040, Section 9-130 <br />VARIANCE PROVISION: <br />Section 8-210 states that where there is practical difficulties or <br />unusual hardships in the way of carrying out the strict letter of <br />the provisions of this ordinance, the Council shall have the power, <br />in a specific case, to permit a variance from the provisions of this <br />ordinance. <br />APPLICANT'S RESPONSE: <br />The attached letter from Kaufman Sign Company explains the nonconforming <br />roof sign (Section 9-140) that had previously existed was damaged by the <br />tornado this past Spring. The applicant was not allowed to replace the <br />roof sign under Section 9-230 (d). (See attached letter to Tom Thumb <br />from City staff). Tom Thumb is now requesting a variance to install a <br />new sign. The applicant feels that the proposed location of the sign <br />is the only other readily available signable area open to them. <br />Diagrams and pictures of the existing building are attached. <br />STAFF ANALYSIS <br />Tom Thumb had a roof sign which is now prohibited under the present <br />code (Section 9-140). The roof sign was damaged during the recent <br />tornado. Tom Thumb was not allowed to replace the roof sign under <br />Section 9-230 (b) and (d), Type I nonconforming signs. The ordinance <br />states that repair of a nonconforming sign is not permitted if the <br />cost of .repairs exceed 50 percent of the fair market value of the sign. <br />In this case, what was left of the roof sign was removed after the storm. <br />A letter was forwarded to Tom Thumb stating that the New Brighton Sign. <br />ordinance did not allow-the roof .sign to be replaced. Tom Thumb feels <br />the proposed sign is the only signing option left to them.. <br />
