July 27, 1984 ~- VN-237 TOM THUMB SIGN PURPOSE To consider a request for a variance to construct a sign. BACKGROUND .APPLICANT: Tom Thumb Stores Representative: Dan Kaufman .Kaufman Sign Company LOCATION:- 375 Silver Lake Road ZONING: B-2, Neighborhood Business VARIANCE REQUEST: To install a sign pinned away .from the wall more than 18 inches (Section. 9-130 d.) CODE REQUIREMENTS: Section 9-040, Section 9-130 VARIANCE PROVISION: Section 8-210 states that where there is practical difficulties or unusual hardships in the way of carrying out the strict letter of the provisions of this ordinance, the Council shall have the power, in a specific case, to permit a variance from the provisions of this ordinance. APPLICANT'S RESPONSE: The attached letter from Kaufman Sign Company explains the nonconforming roof sign (Section 9-140) that had previously existed was damaged by the tornado this past Spring. The applicant was not allowed to replace the roof sign under Section 9-230 (d). (See attached letter to Tom Thumb from City staff). Tom Thumb is now requesting a variance to install a new sign. The applicant feels that the proposed location of the sign is the only other readily available signable area open to them. Diagrams and pictures of the existing building are attached. STAFF ANALYSIS Tom Thumb had a roof sign which is now prohibited under the present code (Section 9-140). The roof sign was damaged during the recent tornado. Tom Thumb was not allowed to replace the roof sign under Section 9-230 (b) and (d), Type I nonconforming signs. The ordinance states that repair of a nonconforming sign is not permitted if the cost of .repairs exceed 50 percent of the fair market value of the sign. In this case, what was left of the roof sign was removed after the storm. A letter was forwarded to Tom Thumb stating that the New Brighton Sign. ordinance did not allow-the roof .sign to be replaced. Tom Thumb feels the proposed sign is the only signing option left to them..
