<br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-236

<br />WHEREAS, an application for a variance, UN-236 has been
<br />made by Donatelle.Tool.
<br />-hHEREAS, the procedural history of the application is as
<br />follows: °~
<br />1. That an application for a variance was filed
<br />with the City on August 6, 1984.
<br />2. That the Planning Commission, pursuant to published
<br />and mailed notices, held a public hearing on August
<br />21,.1984, all person's present at the hearing were
<br />gi~,en an oeportunity to be heard.
<br />3.: "That said request was considered by t"e Council on
<br />August 28, 1984 and staff analysis and Planning
<br />Commission minutes and' recommendation were considered.
<br />WHEREAS, the property is legally .described as the following:
<br />Lots 1, except the North 1/2 thereof, 2,3,4,5,26,27,
<br />28,29 and 30, Block 9, First Addition to New Brighton
<br />together with vacated alley adjoining said lots and
<br />all of vacated Fourth Avenue Northwest adjoining said
<br />lots, and the North 230 feet of the Westerly 300 feet
<br />of that part of the Northeast 1/4 of the Southeast 1/4
<br />of Section 29, Township 30 North, Range 23 West, lying
<br />Easterly of the First Addition to New Brighton together
<br />with vacated Fourth Avenue Northwest and Fourth Street
<br />Northwest lying within the adjacent thereto.
<br />NOW THEREFORE BE IT RESOLVED by the City Council that the
<br />following Findings of Fact are made in respect to VN-236:
<br />

<br />2. That the combination of the poor soil conditions,
<br /> shape of the lot, and large area of street frontage
<br /> substantially hinder development of the site.
<br />3. That the request is for a 20-foot variance from
<br /> County Road "E2" (front yard setback) and a 5-foot
<br /> variance on the rear yard setback.
<br />4. That the front yard setback will. be 40 feet, the •
<br /> standard industrial zoning setback.
<br />5. That the 15-foot rear yard setback will allow for the
<br /> construction of enclosed truck docks.
<br />6. That the applicant has demonstrated unique and un-
<br /> usual circumstances and undue hardship.
<br />BE IT FURTHER RESOLVED that the application UN-236 is and
<br />hereby approved subject to the following condition:
<br />1. Approval of LP-164.
