October 9,1984 <br />LAWSON <br />VN-238 <br />PURPOSE <br />To consider a request for a variance for a side street yard setback for <br />a deck. <br />BACKGROUND <br />APPLICANT: John and Melanie Lawson <br />LOCATION: 1596 28th Avenue NW <br /> (Lot 1 , Block 4, Oakwood: Manor Terrace) <br />ZONING: R-1, Single Family Residential <br />AREA OF SITE: 10,384 Square.Feet <br />REQUIRED SETBACK: Same as the setback of the existing <br /> home, in this case 23 feet. <br />REQUESTED SETBACK: Zero Feet. <br />CODE REQUIREMENTS: Section 4-030(c), Lot Standards <br /> The following-minimum setbacks shall <br /> be observed: Feet <br /> Side Street Yard 30 <br /> Front Yard 30 <br /> Side Yard 5 <br /> Rear Yard 5 <br /> A side street yard on a corner lot <br /> shall not be less. than thirty (30) <br /> feet in width for any construction <br /> after August 21, 1981 (the date this <br /> ordinance becomes effective). Any <br /> property already improved August 21, <br /> 1981 by construction of a principal <br /> structure with a fifteen foot side <br /> street yard setback shall not be <br /> considered non-conforming in regard... <br /> to side street yard setback. In <br /> cases where adjacent properties are <br /> already improved, the Council can <br /> grant special permission to change <br /> the setback requirements on a corner <br /> lot, based on the criteria of visual <br /> compatibility with surrounding <br /> properties.. <br /> Section 8-210, Variance <br /> Where there are practical difficulties <br /> or unusual hardships in the way of <br /> carrying out the strict letter of the <br /> provisions of this ordinance, the <br /> Council shall have the power, in a <br /> specific case, to permit a variance <br /> .from the ,provisions of this ordinance. <br />
