RESOLUTION NO <br />.~' NEW BRIGHTON PLANNING COMMISSION <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING DENIAL OF <br />VN-238, for a less than required side street yard setback. <br />WHEREAS, an application for a variance has been made by John <br />and Melanie Lawson; and <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application for a variance was filed with the City <br />on September 28, 1984. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on October 16, 1984, <br />all person's. present at the hearing were given an <br />opportunity to be heard. <br />WHEREAS, the logal description of the property is as follows: <br />f• <br />Lot 1 , Block 4, Oakwood Manor Terrace. <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that <br />the folloiwng Findings of Fact are made in repsect to UN-228: <br />1. That the property is zoned R-1, Single Family Residential, <br />2. That the required side street-yard setback for the deck_ <br />would be equal to the setback of the existing home .under <br />Section 4-040(c) of the New Brighton .Zoning Code. <br />3. That the applicant is requesting a zero side street yard <br />setback. <br />4. That the applicant has failed to demonstrate unique and <br />unusual circumstances and undue hardship applying to <br />the preperty. <br />5. That there does exist room on the site to construct a <br />deck within the district setback requirements. <br />BE IT FURTHER RESOLVED that the application VN-238 is .and <br />hereby recommended for denial. <br />Adopted this 16th day of October, 1984. <br />Roger S.
