STATE OF MINNESOTA .COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND DENYING APPLICATION FOR VN-238, fora less than required Side street yard setback. .:.:WHEREAS, an application for avariance has been made by John and Melanie :Lawson; and WHEREAS, the .procedural history of the application is as follows: 1. That an application fora variance was. filed with the City on September 28, 1984. 2. .That the Planning Commission,.pursuant to published. and mailed notices, held a public hearing on October 16, I, 1984, a77 pe;~son's present at the hearing were given an. ', opportunity to be heard. 3. That such application was reviewed by the City Council on'~ .October 23,.1984.. 4. The written comments and analysis. of the City staff, the Planning Commission minutes and recommendations were considered. I WHEREAS, the legal description of the property is as follows: Lot 1, Block 4, Oakwood Manor Terrace. NOW THEREFORE BE IT RESOLVED, that the `New Brighton City Council makes the following Findings of Fact in respect to VN-238: 1 . That the property i s zoned R-1 , Single Family .Residential. 2. That the required side street yard setback for the deck would be equal to the setback of the existing home under Section 4-040 (c) of the New Brighton Zoning Code. 3. That the applicant is requesting a zero side street yard setback. 4. That the applicant has .failed. to demonstrate unique and unusual circumstances and undue hardship. applying to the: property. 5. That.-there does exist room on the site to construct a .deck within the district setback requirements. 8E IT FURTHER RESOLVED, that the application VN-238 is hereby ', denied.
