RESOLEJTTON N0. <br />NE4J BRIGHTON PLANNING COMMISSION <br />RESOLt1TI0N ~?AKI`VG FINDINGS OF FACT AND RECO~{MENDING APPROVAL OF <br />SP-120 for an eight-foot fence in a front yard.. <br />WHEREAS, an application for a special use permit .has been <br />made by Roseville Diesel, Inc. <br />WHEREAS, the procedural history of the application is as <br />follo~,~~s: i <br />1. That an application for a special use permit was filed <br />with -the ~.ity on November 5; 1984. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public .hearing on November 20; <br />1984, all person's present at the hearing were given an <br />opportunity to be heard. <br />WHEREAS, the property is legally described as: <br />That part of the North 225 feet. of the South 785 <br />feet of the Northwest 4 of the Southeast 4 of Section <br />29, Township 30, .Range 23, lying 4!est of the land <br />conveyed to the Minneapolis, St. Paul and Sault Ste. <br />Marie Railway Company in "530" Deeds 135, except the <br />North 100 feet of the South 660 feet of the West 140 <br />feet of said Northwest 4 of Suut,~east 4 of Section 29, <br />Township 30, Range 23. <br />Subject to easements of record. <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that <br />:the following Findings of Fact are made in respect to SP-120: e <br />1. That the property is zoned I-1, Light Industrial. <br />2. That the existing building is setback 115 feet from <br /> Old Highway 3. <br />3. That there is an existing berm which visually obscures <br /> much of the building from. Old Highway 8. <br />4. That the fence will be setback 101., feet from Old <br /> High way 8. <br />5. That the fence conforms to all aspects of the ordinance <br /> exce pt for height. <br />n. That the seven-foot chain link fence with one- foot of <br /> barb ed wire in the front yard is necessary for security <br /> of t he property. <br />7.
