NO. 84-173_ ~ STATE OF MINNESOTA COUNTY OF RPIMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT ANb APPROVING VN-240 for an eight-foot fence in a front. yard. WHEREAS, an application for a variance has been made by Roseville Diesel, Inc. WHEREAS, the procedural history of the application is as follows: 1. That an application for a variance was filed with the City on November 5, 1984. 2. That the Planning Commission, pursuant to published and mailed notices, held a public hearing on November 20, 1984, all person's present at the hearing were given an opportunity to be heard. 3. That the application for a variance was reviewed by the City Council on December 11, 1984. 4. That the comments and analysis of Staff and the Planninc Commission minutes and .recommendations were considered. WHEREAS, the property is .legally described as: That part of the North 225 feet of the South 785 -feet of the Northwest 4 of the Southeast_4 of Section 29, Township 30, Range 23, lying West of the land conveyed to the Minneapolis, St. Paul and Sault Ste. ~~ ~~ Marie Railway Company in 53C Deeds 135, except the North 100. feet of the South 660 feet of the 4Jest 140 feet of said Northwest 4 of Southeast '~ of Section 29, Township 30, Range 23. Subject to easements of record. NOW THEREFORE BE IT RESOLVED by the City Council that the following Findings of Fact are made in respect to VN-240. 1. That the property is Zoned I-1, Light Industrial. 2. That the existing building is setback 115 feet from Old Highway 8. 3. That there is an existing berm which visually obscures much of the building. from Old Highway 8. 4. That the fence will be setback 101.5 feet from Old Highway 8. 5. That the fence conforms to all aspects of the ordinance except for height. 6. That the seven-foot chain link fence with one-foot of barbed-wire. in the front yard is necessary for security of the property. 7. That the construction of the proposed fence is con- sistent with the purpose and intent of the fence regulations.
