<br />T H E R M O KING SALES A SERVICE, INC. <br />1951 Old Highway 8 • New Brighton, MN 55112 • (612) 633-2820 <br />August 2, 1985 <br />City of New Brighton, Planning Commission <br />City of New Brighton, City Council <br />803 5th Avenue N.W. <br />New Brighton, MN 55112 <br />Gentlemen: <br />We are hereby requesting a variance for installation of a fence which we <br />have been informed by Ms. Brenda A. Krueger, the City Planner, is in <br />violation of New Brighton City Code Section 6-400, the violation being that: <br />1. The fence extends beyond the front of our building line <br />2. The fence exceeds the three and one-half (31) foot height restriction <br />This is, as you are probably aware, the second time we have requested this <br />variance and, accordingly, we beg your indulgence in this matter. <br />Enclosed is a scale drawing of our plot plan indicating the section of <br />our fence for which the variance is requested. We have occupied our new <br />building for almost one year and have found that we need the area on the <br />northwest corner of our property for snow storage in the winter months. <br />Because of the large drives and parking areas on our lot, we have to push <br />snow a great distance beyond the edge of the parking areas to ensure <br />sufficient room for additional snow falls. <br />The north boundary of our parking area is bordered closely with fencing <br />on the westerly end and a ponding area on the easterly end. After a <br />couple of snow falls, we cannot push snow into these areas because of <br />space limitations. The eastern edge of this area is limited by the ponding <br />area and a berm with a sharp incline off the east side to the freeway <br />right of way. The alternative to using the northwest corner would be to <br />purchase a huge frontloader to dump snow over the fence. This would be <br />cost prohibitive and create an undue hardship financially. The nature <br />of our business precludes us from relying on contract snow removal because <br />of the uncertainty of the snow being plowed immediately after a snow fall. <br />We provide twenty four hour emergency service for our customers. <br />We would like to call to your attention that our property is somewhat <br />unique because of the huge right of way on old Highway 8. The closest <br />our fence comes to the curb is fifty plus feet. Our building is set back <br />ninety plus feet from the curb. In a customary setting our building <br />set back would be in line with our fence. A large area of our property <br />was made unusable because of the ponding area required by the Rice Creek <br />Watershed District.
