RESOLU ION No 84-24 <br />NEW BRIGHTON PLANNING COMMISSION <br />RESOLUTION MAKING FINDINGS OF FACT.AND RECOMMENDING DENIAL OF <br />VN-241 <br />WHEREAS, an application for a variance has been made by <br />Thermo King for a seven (7) foot fence in a front yard setback; <br />and <br />i <br />I <br />i <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application for a variance was filed with the <br />City on November 6, 1984. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on December 18, <br />'? 1984, all person's present at the hearing were given an <br />opportunity to be heard. <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission <br />that the following Findings of Fact are made in respect to <br />VN-241 : <br />1. That the property is zoned I-1, Light Industrial. <br />j 2. That the applicant has not shown that unique or unusual <br />circumstances exist.. <br />3. That denial of the variance will not result in undue <br />hardship for the applicant. <br />4. That there exist alternative methods to secure the <br />water well from tampering. <br />5. That granting of a variance would not be consistent <br />with Section 4-540 (a), purpose of the fence-ordinance, <br />because of the possibility of parking and storage areas <br />` encroaching into the front yard,thus affecting orderly <br />development of the property.. <br />it Adopted this <br />?i <br />i? <br />i! <br />18th day of December, 1984. <br />Brenda A.
