VN-2.43
August 16, 1985
Page 2
APPLICANT'S RESPONSE
In t..e attache.d etter th.e applicant states that since they moved
into their building one year ago they have discovered additional hard-
ships which they feel would warrant reconsideration of their variance
request. The applicant states the area enclosed by the fence is badly
needed for snow storage in the winter, which they had not realized
previously. The applicant also stresses the large right-of-way along
Old Highway 8 which has the fence setback over 50 feet from the curb,
the adjacent residential land uses and PCA's request to use the well
(.located in the northwest corner of the site) as a monitoring well.
STAFF ANALYSIS
As background information the applicant's building was approved for
construction on April 10, 1984 under LP-156. The approved site plans
had the. fence located in th.e correct location, in line with the front
of the building. The applicant changed the location of the fence upon
completion of th.e building. When informed by staff the fence would
have to be. moved the applicant decided on the alternative and applied
for a variance. The variance request was for the fence both north of
th.e building and south of the southern most driveway.
The applicant has identified the following circumstances they feel
warrant a variance.
1. To protect themselves against possible injury of
unauthorized persons on their property, primarily
from the two single family homes to the south and
one single family home to the north.
2. To protect the existing well on the northwest corner
of the site and permit the PCA to monitor the well.
3. The need for the area enclosed by the fence to be
used for snow storage. There are few snow storage
alternatives for.that area north of the building.
Snow storage in the ponding area is difficult because
the snow plows get stuck if they go too far down into
the parking area.
4. The large right-of-way along Old Highway 8 which has
the fence located over 50-feet from the curb.
The staff's response to each of the four items identified by the
applicant are as follows:
1. The area in which the applicant's building is located
is zoned industrial, including the nearby single family
homes. Although these few homes remain in the area the
area is primarily made up of industrial uses. The home
to the north of Thermo-King is now used as a business.
As stated in the 1984 staff report the existing homes
do not create undue hardship (ability to use the land
or operate a business on the property). The driveway
entrances have wide visibility, excellent for incoming
and outgoing vehicles. The distance of the southern
driveway from the property line of the first home south
