`VN-243
Page 3
The applicant has identified the following circumstances they feel
warrant a variance.
1. To protect themselves against possible injury of
unauthorized persons on their property, primarily
from the two single family homes to the south and
one single family home to the north.
2. To protect the existing well on the northwest corner
of the site and permit the PCA to monitor the well.
3. The need for the area enclosed by the fence to be
used for snow storage. There are few snow storage
alternatives for that area north of the building.
Snow storage in the ponding area is difficult because
the snow plows get stuck if they go too far down into
the parking area.
4. The large right-of-way along Old Highway 8 which has
the fence located over 50-feet from the curb.
The staff's response to each of the four items identified by the
applicant are as follows:
1. The area in which the applicant's building is located
is zoned industrial, including the nearby single family
homes. Although these few homes remain in the area the
area is primarily made up of industrial uses. The home
to the north.of Thermo-King is also used as a business.
As stated in the 1984 staff report the existing homes
do not create undue hardship (ability to use the land
or operate a business on the property). The driveway
entrances have wide visibility, excellent for incoming
and outgoing vehicles. The distance of the southern
driveway from the property line of the first home south
of Thermo-King is 340 feet.
2. The well on the northwest corner of the site is hooked
up to a 480 volt power supply by the applicant. I agree
with the applicant that the well will need to be protected.
However, as was discussed by the staff and Planning Com-
mission in 1984 there are alternatives to secure the well
without fencing in the entire area north of the building.
A small security shed may be one alternative. I was con-
tacted by PCA about the well and fence. PCA stated that
for their purposes they do not need electricity hooked up
to the well and can secure the well with a locking cap.
3. It is.apparent that snow storage for that area of the
site north of the building is a problem for the applicant.
Because it is the nature of the applicant's business to
provide 24 hour emergency service for the repair of semi-
truck refrigeration units they must be able to maintain
access around their property at all times. The ability
of the applicant to operate the business might be impaired
if an alternate solution could not be found.
4. Old Highway 8 has 225 feet of right-of-way from Lowy Enter-
prises north to the City boundry. This right-of-way is ex-
cessive. Large road right-of-ways have been grounds for a
