St. N.W.. <br />New Brighton, MN 55112 <br />RE• .Long Lake Park Metro Funds <br />Dear Mr. Fornell: <br />At your request, I have examined the docuir~ents concerning the. bonds or <br />monies used in the acquisition of the Park to wit Resolution No. 347 of <br />.the Village of New Brighton, together with Resolution No. 379 of the <br />~ Village of New Brighton concerning the question on the issuance of bonds. <br />for the acquisition and betternnent of parks in the Village. <br />The bonds issued pursuant to these. elections are general obligation <br />bonds of the City and the land acquired in Long Lake as acquired under <br />condetmation proceedings for park purposes. <br />It is my .understanding that under any acquisition by Ramsey County or - <br />the Metropolitan Council, the land in question would continue to be <br />used for park and recreation purposes but the ultimate control of the <br />site would be in the hands of Ramsey County pursuant to the terms of a <br />master plan developed under a Joint Pavers Agreement by the City and the <br />County. <br />Under these circumstances, there is no constraint on the~use of the-money <br />.that might be obtained in the transfer of such property to Ramsey County <br />by reason of the bonds .for the notice of bonding.- The City Council can <br />make whatever use it deems necessary or appropriate for the best interest <br />of the City of any such funds unless there is seer constraint on the <br />fundsthemselves as paid over by the Metro Council and/or Ramsey County. <br />Sincerely, <br />I SI, P.A. <br />ld L.
