between the developer and the community must be the differing <br />factors between the two (2) master development proposals. In <br />each of these instances the Kraus-Anderson proposal would seem <br />to have the advantage. Kraus-Anderson has a solid reputation <br />and substantial similar experience, including experience as a <br />developer, builders and owner of property within the City of <br />New Brighton. They also have been involved throughout the <br />downtown development process and therefore, the City has had the <br />opportunity to become familiar with. the firm and its personnel. <br />Considering the substantial amount of cooperation that will be <br />necessary between the developer and the City in order to <br />implement the downtown development project, the communities <br />confidence in and compatibility of personalities should be <br />considered in selecting the exclusive master developer for down- <br />town. <br />Joint Planning Agreement <br />Attached is the Joint Planning Agreement that has been agreed to <br />by Kraus-Anderson. Highlights of the agreement are as follows: <br />1) Kraus-Anderson would be given 180 days to work with the <br />City in developing a detailed redevelopment plan. <br />2) Kraus-Anderson agress to work with the other groups/ <br />individuals who have expressed an interest in downtown. <br />3) Kraus-Anderson would be responsible for developing <br />design criteria or standards consistent with the <br />overall plan to be developed. <br />4) Kraus-Anderson must submit financing plan showing <br />ability to undertake and complete plan. <br />5) City agrees to re-imburse for development of design <br />criteria, subject to execution of a Joint Planning <br />Agreement. <br />6) City agrees to not enter into other agreements for <br />period of .180 days. <br />7) city agrees to prepare site acquisition plan, public <br />improvements plan and financing plan when sites are <br />identified by developer. <br />8) Agreement is non-binding and can be terminated by <br />either party after 180 days or upon failure to perform. <br />This agreement attempts to accomplish or address the concerns of <br />the Downtown Advisory Board and City Council, as well as the <br />objectives of the Joint Planning Agreement, all of which include: <br />1) An attempt to provide for participation in the <br />redevelopment by those who are already downtown and <br />those who have expressed an interest in smaller, single <br />purpose projects. <br />2) Preparing a detailed redevelopment plan that will <br />hopefully satisfy the goals, objectives and interests <br />of the City, existing businesses and others who have <br />expressed interest in locating downtown, and the <br />developer. <br />-6- <br />
