Motion by Schmidt, seconded by Williams, to DIRECT STAFF, INCLUD- ING LEGAL COUNSEL, TO ASSESS THE COURT'S EFFORTS AND INTENT AND TO WHAT EXTENT THEY WILL BE MOVING THE JURY TRIALS AND OTHER MATTERS OUTSIDE THIS COURT SYSTEM AND RECOMMEND ACTION FOR THE CITY OF NEW BRIGHTON TO PARTICIPATE WITH OTHER CITIES IN RESOLV- ING THE MATTER LEGISLATIVELY VERSUS JUDICIALLY. 5 Ayes - 0 Nayes, Motion Carried Brandt asked to have the Seminary Estates street light matter removed from the Consent Agenda because she believed the curve from Seminary Drive along with the distance between the light on Stinson Boulevard and the proposed light on Yankton College Drive justifies another street light. Proper reported he was not sure of the distance but would check and report back to council. Motion by Gunderman, seconded by Schmidt, to WAIVE THE READING AND ADOPT A RESOLUTION ORDERING THE INSTALLATION OF FIVE NEW STREET LIGHTS IN THE SEMINARY ESTATES SUBDIVISION, AND TO HAVE STAFF DETERMINE THE POSSIBILITY OF LIGHTING SEMINARY DRIVE BETWEEN STINSON BOULEVARD AND YANKTON COLLEGE DRIVE. 5 Ayes - 0 Nayes, Motion Carried As Winkels had not yet arrived, Locke reviewed the progress to date and distributed plans Winfield Developments, Inc. is current- ly using for the financing and development portions of the pro- ject. The key ingredient is financing for the project and Winfield has hired Jay O'Neil. Winfield has asked the city to put up a leasing sign on the site. Winkels has met with Sinda, Locke, and Jim O'Meara (representative of bond counsel, O'Connor & Hannan) and a draft development agreement is being prepared for the a council agenda in January. Locke indicated the original proposal for Bel Air and Winfield for Tax Increment Distict No. 6 had been through the PRO and planning process; they both need to go back through that process, which begins with the Planning Commission, of public hearings which will be started so that when they are ready to sign, the approvals will all be in place.
