<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 10. 1986 <br /> <br />Public Hearing. continued <br /> <br />Schmidt asked if staff was aware of when the ownership problem <br />was resolved; Matilla stated there were several developers <br />interested in that site and that when the last proposal for six <br />units was turned down. the applicant was given the impression <br />that four units would be allowed. <br /> <br />Bev Smith. representing the applicant. William Barbush. had no <br />comments and felt staff had explained the situation fully. <br /> <br />There being no further questions or comments from either the <br />council. Schmidt moved, seconded by Williams. to CLOSE THE PUBLIC <br />HEARING. <br /> <br />4 Ayes - 0 Nayes. Motion Carried <br /> <br />Motion by Gunderman. seconded by Schmidt. to WAIVE THE READING <br />AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROVING <br />VN-249; and RESOLTUION MAKING FINDINGS OF FACT AND APPROVING <br />PRELIMINARY PLAT PL-150. <br /> <br />4 Ayes - 0 Nayes. Motion Carried <br /> <br />Council Business <br /> <br />Matilla briefly reviewed and explained the staff report concern- <br />ing an appeal of the City Planner's interpretation of Section <br />4-030(a) of the Zoning Code which allows schools but not day <br />care centers as a permitted special use in the R-l. Single Family <br />Residential District. <br /> <br />Focusing on the primary functions identified by staff. educa- <br />tional versus day care. Schmidt stated the city had restricted <br />day care activities to R3 districts with a special use permit <br />and asked if staff had visited the present site; Matilla <br />responded he had not had the opportunity to visit the site. <br /> <br />Recognizing the two services of the facility (day care and <br />educational) and based on personal experience, Schmidt strongly <br />believes the primary service provided by the Harbon Montessori <br />Schoo 1 is educat ion. <br /> <br />Gunderman agreed with Schmidt. but expressed concern for safety <br />if the location were to be moved to the Long Lake Road/14th Ave. <br />N.W. area. <br /> <br />Benke indicated he also had difficulty saying the Montessori <br />School was not an educational facility but felt concern. also. <br />about the safety factor on the proposed site. <br /> <br />Page Three <br /> <br />Counc i1 Bus i ness <br /> <br />Appeal: 4-020(A) of <br />City Code - <br />Harbon Montessori <br />School <br />Report 86-274 <br />
