<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 14, 1986 <br /> <br />Public Hearings, continued <br /> <br />Williams understands that the project was based on the premise <br />that the land would be acquired. <br /> <br />LeFevere stated the hardship under the application for a variance <br />has to do with circumstances that are unique to the land that <br />imposes some hardship, in this case development constraints. <br />LeFevere continued that we are not talking of a hardship, econ- <br />omic or otherwise, in deciding whether or not to expand the <br />development district, but are talking about enhancing economic <br />development in the city which is an entirely different question. <br /> <br />E. Jeppson suggested a development with a cul de sac would have <br />one drive for ingress and egress and would have fewer cars coming <br />and going than with an office building. <br /> <br />With regard to less activity during the evening and on weekends, <br />E. Jeppson noted that Briggs had stated they are in the real <br />estate business and there would be traffic in and out during <br />evenings and on weekends (so the residents can expect the lights <br />will be on during the evenings and that there would be traffic on <br />weekends). <br /> <br />In regard to Schmidt's comments that the council needs to look <br />deeper into the Development Agreement, in view of the fact council <br />had no Development Agreement to look at, E. Jeppson asked why <br />council is even responding to anything. <br /> <br />Benke stated the terms and conditions of the Development Agree- <br />ment are consistent with previous agreements and the council is <br />familiar with those conditions and requirements; Locke indicated <br />the Public Hearing is not for the Development Agreement, but <br />rather for the expansion of the development district, and that <br />all items were being discussed simultaneously because they all <br />interrelate. <br /> <br />Briggs stated Harstad Companies has one person in their real <br />estate office; most business is conducted at the homes they are <br />building; they do not sell homes other than the ones they have <br />built; and that occasionally a client will stop by the office <br />about 5:30 or 6:00 p.m. to review plans with Harstad's architect. <br /> <br />Benke stated it is understood there will be limited traffic on <br />weekends and evenings. <br /> <br />In response to M. Jeppson's concern, Benke stated the hardship <br />was specifically the fact that the water drainage area on the <br />parcel was serving the community to the unfair advantage of the <br />property owner. <br /> <br />Page Nine <br />
