On Parcel No. 8, Joe Bettendorf testified to a value <br />of $57,000.00; Stanley Mi11er, on behalf of the owner, testified <br />to a value of $275,000.00; and the Commissioners award was <br />$~l,ooo.oo. <br />7. On Parcel Noe 9, Joe Bettendorf testified to a value <br />of $17,500.00; the owner, Richard Miller, testified to a value <br />of $179,000,00; and the appraiser for the owner testified to <br />a value of $184,000x00; the Commissioners Award was $29,500.00. <br />An adjustment in the award for Parcel No. 8 for the existence <br />~of a pipeline easement wi11 be forthcoming by the first of <br />September; but we requested that the aT.aard be filed at this <br />.time so that the Village could decide whether to acquire or <br />not. The end value on Parcel No. 8 wi11 be somewhat reduced <br />by the adjustment for the easement, but a delay in the <br />location and description of the pipeline easement precluded <br />.that being taken into account prior to the filing of -this <br />awardo <br />The possibility of appeals is very high on Parcels 4, 5, 6, <br />8 and 9. The Village and each of the landowners has the <br />' right to appeal from this award at any time up to and including <br />September 8, 1970. The Village may, prior to that date, <br />_ elect to abandon the taking. If the Village does not <br />abandon the condemnation on or before September 8, the Village <br />has then purchased the park and wi11 be obligated to pay the. <br />commissioners award or any other figure determined on appeal <br />or any figures arrived at by negotiations between the parties; <br />but it must be clearly understood that unless the taking is <br />abandoned prior to September 8, 1970, the Village cannot <br />avoid the purchase except by the consent of the, respective <br />landowners.
