<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 9, 1986 <br /> <br />Council Business, continued <br /> <br />LeFevere stated the existing ordinance is workable from a legal <br />point of view (sign has to be placed with the owner's permission, <br />the owner is responsible for removal) and questioned whether or <br />not a candidate could be prosecuted for not removing a sign, as <br />per Witzke's suggestion. <br /> <br />Williams could not imagine that anyone would complain about <br />someone from the city or a candidate entering their private <br />property to pick up a political sign and remove it; LeFevere <br />stated that perhaps no one would complain, but it could be <br />justified as trespassing. <br /> <br />Benke asked if it could be written into the code that granting <br />permission to display the sign is also giving approval to remove <br />it; LeFevere stated that would be acceptable. <br /> <br />Motion by Gunderman, seconded by Brandt, to REFER THE ISSUE OF <br />CAMPAIGN SIGNS TO THE CITIZEN STUDY COMMISSION AND STAFF TO <br />REVIEW (with Witzke) WITH LEGAL OPINIONS, AND HAVE A RECOMMENDA- <br />TION IN ADVANCE OF THE 1987 ELECTIONS. <br /> <br />In response to Witzke's question, Benke felt the city should sug- <br />gest to the candidates their current signs should be removed. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Announcements and Updates <br /> <br />With regard to the flag-raising ceremony, Gunderman asked that <br />the event be postponed until the first part of October, at which <br />time there will be a kick-off for the Centennial, if all of the <br />plans fall into place. <br /> <br />Benke asked that council be advised when appropriate plans and <br />preparations are finalized. <br /> <br />Schmidt advised that a public hearing has been set for September <br />18, 1986, on the application for transfer (Group W interest to <br />Hauser) and on September 17, 1986, there will be a governmental <br />access forum for all city officials and staff at Falcon Heights <br />City Hall (beginning at 3;00 p,m., 5;00 p,m. dinner meeting, <br />followed by a post-dinner program). <br /> <br />Benke announced the Chamber Committee is having a booth at the <br />Business Expo at the Convention Center on September 10th and 11th <br />(Noon-6 p.m. and 10 a.m.-6 p.m., respectively) at which time they <br />will be promoting the City with video tape, remodeled city hall, <br />etc. <br /> <br />Page Nine <br /> <br />Announcements <br />and Updates <br /> <br />Flag-Raising <br /> <br />Cable Update <br /> <br />Business Expo <br />
