HEAD'S APPROVAL <br />N/A <br />MANAGER'S REVIEW/RECOMMENDATION: <br />No comments to supplement this report Comments below/attached <br />EXPLANATION/SUMMARY (attach supplemental sheets as necessary): <br />Attached is a resolution authorizing sale/transfer of Long Lake Park <br />property to Ramsey County in return for a payment of $698,101. This <br />action has been challenged by the Long Lake Improvement Association, <br />however in a ruling by Judge Otis Godfrey he stated that "the court <br />is not persuaded that the proposed use is a substantial variation <br />from the original purpose presented to the voters who approved a bond. <br />issue 15 years ago for the purchase of the property as a park." Judge <br />Godfrey refused to grant the temporary injunction sought by the L.L.I.A. <br />The Environmental Quality Board met on November 18th and after a <br />lengthy. hearing, determined nn a 7-1 vote that there is no need to <br />prepare an E.I.S. The Long Lake Improvement Association has filed <br />an appeal of the decision with Ramsey County District Court. The <br />appeal process could take another two months, however the City Attorney <br />feels there is little chance of the E.Q.B. decision being overturned. <br />The court has at least three options; they could affirm the E.Q.B. <br />decision, overturn it, or return the matter for reconsideration. <br />Even though the appeal is pending, Metro Council is releasing develop- <br />ment funds for the park, thus tie only apparent obstacle to preparation <br />~f plans and specs and early 1983 development is the title transfer.. <br />With development funds now released by Metro Council, the park develop- <br />ment cou]_d occur concurrent with preparation of an E.I.S. even if the <br />L.Q.B. decision was overturned. <br />Continued... <br />Recommendation <br />To authorize Mayor and City Manager to execute the resolution author- <br />. izing sale of the land and accepting the reimbursement of $698,101 <br />and further directing staff to communicate with Ramsey County a willing- <br />ness on the part of the City to complete the removal of sludge from <br />the "tar pits." <br />.--~ <br />Maurice H.
