Andersq~~ctor Parks and Recreation <br />Re: Ramsey County/City of New Brighton Joint Powers Agreement <br />The Ramsey County Board has approved the master plan for Long <br />Lake Park. The plan was approved as amended by the New Brighton <br />City Council. <br />The County Board also approved a Joint Powers Agreement in different <br />form than the city approved agreement. The revised Joint Powers <br />Agreement must be reviewed and approved by the Park Board and <br />City Council. Item #7 was revised: <br />Pre- 7. This agreement shall terminate on December 31, <br />vious 2000, unless the agreement is revised or termi- <br />Language nated upon. terms mutually agreeable to the <br />parties. The parties expressly agree that any <br />disputes arising hereunder that are not san s- <br />factorily resolved shall, upon application of one <br />of the parties herto be submitted to an arbitrator <br />who will. have .full authority to resolve the dispute. <br />The parties expressly agree that transfer of fee <br />title to Long Lake Park from the City to the County <br />prior to the termination date of this agreement shall <br />not accelerate the date of termination. <br />New 7. It is agreed between the parties that their re- <br />Language spective responsibilities as defined herein shall <br />continue to be binding and enforceable until modi- <br />fied or amended by mutual agreement of the parties; <br />provided, however,. it is further agreed that the <br />parties shall in good faith on or before December 31, <br />1984 renegotiate terms of this agreement, specifically <br />those terms relating to the responsibilities of the <br />respective parties for the operation and maintenance <br />of the Long Lake Regional Park. <br />The new language gives the City a full range of options in 1984 and <br />guarantees that the agreement remains in effect even if a new agree- <br />ment cannot be reached. The new language appears to be a good com- <br />promise for both parties. <br />The next step, if the New .Brighton .City Council approves the new <br />language in the Joint Powers Agreement, is the Metro Council Park <br />.and Open Space Commission. The tentative date for consideration <br />is June 7, 19$2 with full Council consideration to occur later in <br />June. Is June a good month for a celebration? <br />
