JOINT POWERS AGREEMENT <br />RELATING TO <br />MA7:NTE;1`TRNCE AND OPERATION <br />Ol? LONG I~h,KT/RUSTT LAKE REGIONAL PARK <br />This agreement is made this day of , <br />19 between the County of Ramsey, State of Minnesota (County) <br />and ~C'it~y of New flriclhton, County of Ramsey, State of Minnesota <br />(City). This agreement is entered .into pi:rsuant to Minnesota <br />Statutes Section 471.59 {1980). <br />Whereas, portions of Long Lake/Rush Lake Regianal Park <br />ar.e cu.r.rently awned by the County, and other portions are <br />currently awned by the City, and <br />whereas, both parties recognize the regional significance <br />of the Long Lake/Rush Lake parks, and <br />Whereas, the County has been designated "implementing <br />agency" to the Metropolitan Council for Long Lake/Rush Lake <br />Regianal Park, and <br />Whereas the County and City are engaged in negotiations <br />to rectify the problems created by dual ownership of Long Lake/ <br />Rush Lake Regional Park, and <br />Whereas, both parties recognize that the uncertainty of <br />funding for maintenance and operation costs of the regional <br />park has been an ir~ipediment to these negotiations and also <br />to development of the park, <br />The County and City hereby enter into this agreement <br />regarding operation and maintenance costs for the purposes <br />of expP_dltll"!~1 the development of Long Lake/Rush Lake Regional <br />Park and ea:~ing the problems created by dual ownership of the <br />park, and hereby agree as follows: <br />1. The City shall, at it sole expense, provide the <br />maintenance and operation services listed below: <br />a, The City shall provide police services and <br />the at=tendant attorney ser.vice:~ necessary for <br />prosecution of misdemeanors for the entire <br />Long Lame/Rush Lake Regional Park. <br />b. The City shall provide fire protection services <br />far the entire Long Lake/Rush Lake Regional Park. <br />c. The City shall continue to conduct a public <br />beach r~per_ation on Long Lake and be wholly <br />respansihle ther.efor.. The beach operation <br />inr,ludes, but is not lim:it:ed to, maintenance <br />of the beach area, provision of lifeguards, and <br />oper.at.ion of concession stands or clubhouse facilities, <br />if any. Any receipts obtained by the City for such <br />cancession stands or clubhouse facilities may be <br />retained by the City. <br />
