Andersf~~~,~~T~Yector Parks and Recreation Re: Joint Powers Agreement for Maintenance and Operation of Long Lake Park One of the major sticking points in previous discussions of the joint powers agreement and the potential master plan has been Ramsey County Park and Open Space staff's desire to have a termin- ation date of 1984 in the agreement. City staff, Park Board and Council have all expressed concern that this raises the possibility of the County unilaterally deciding not to renegotiate the agreement. Stated simply, the City wishes to keep its options open, the County, as designated implementing agency and potential fee owner, feels it should not be bound to renegociate the agreement. The approved joint powers agreement, item #7, reads: 7. This agreement shall terminate upon the date of completion of the Metropolitan Council's 1984 Policy Plan Review of Long Lake/Rush Lake Regional Park, or the date of December 31, 1984, whichever shall occur first, unless the agreemen~, is extended or revised upon terms mutually agreeable to the parties. The parties expressly agree that transfer of fee title to Long Lake Park from the City to the County prior to the termination date of this agreement shall not accelerate the date of termination. Ramsey County staff proposes a slightly modified version that reads: 7. This agreement shall terminate upon the date of com- pletion of the Metropolitan Council's 1984 Policy Plan Review of Long Lake/Rush Lake Regional Park, or the date of December 31, 1984, whichever shall occur first. The parties expressly agree that transfer of fee title to Long Lake Park from the City to the County prior to the termination date of this agreement shall not accelerate the date of termination. This "softens" the statement to some extend, however the basic idea of County control remains.
