Andersf~~~,~~T~Yector Parks and Recreation <br />Re: Joint Powers Agreement for Maintenance and Operation of <br />Long Lake Park <br />One of the major sticking points in previous discussions of the <br />joint powers agreement and the potential master plan has been <br />Ramsey County Park and Open Space staff's desire to have a termin- <br />ation date of 1984 in the agreement. City staff, Park Board and <br />Council have all expressed concern that this raises the possibility <br />of the County unilaterally deciding not to renegotiate the agreement. <br />Stated simply, the City wishes to keep its options open, the County, <br />as designated implementing agency and potential fee owner, feels <br />it should not be bound to renegociate the agreement. <br />The approved joint powers agreement, item #7, reads: <br />7. This agreement shall terminate upon the date of <br />completion of the Metropolitan Council's 1984 Policy <br />Plan Review of Long Lake/Rush Lake Regional Park, or <br />the date of December 31, 1984, whichever shall occur <br />first, unless the agreemen~, is extended or revised upon <br />terms mutually agreeable to the parties. The parties <br />expressly agree that transfer of fee title to Long Lake <br />Park from the City to the County prior to the termination <br />date of this agreement shall not accelerate the date of <br />termination. <br />Ramsey County staff proposes a slightly modified version that reads: <br />7. This agreement shall terminate upon the date of com- <br />pletion of the Metropolitan Council's 1984 Policy Plan <br />Review of Long Lake/Rush Lake Regional Park, or the <br />date of December 31, 1984, whichever shall occur first. <br />This agneemev~t may be extended an. nev,c~ed u~an ~e~un-s mutua.P.2y <br />aece~~ab.~e ~a the C.cty and the Cauvity. The parties expressly <br />agree that transfer of fee title to Long Lake Park from <br />the City to the County prior to the termination date of <br />this agreement shall not accelerate the date of termination. <br />This "softens" the statement to some extend, however the basic idea <br />of County control remains. <br />
