r <br />This request was instigated when Cheetah Precision met with staff to propose an addition <br />that would connect the existing two industrial buildings at 52 & 55 Mounds Avenue. <br />After several meetings with staff it became clear that maintaining the Mounds Avenue <br />road drainage per City standards was not cost effective for Cheetah Precision. This is <br />because the drainage patterns for the Mounds Avenue road drainage flow overland west <br />to east to Interstate 35W. If Cheetah Precision were to construct an addition, the City <br />would require that the Mounds Avenue road drainage be diverted around the building in a <br />pipe. Because the only property impacted by the Mounds Avenue road drainage is <br />Cheetah Precision, an alternative would be to vacate the public road at which point <br />Cheetah could handle this drainage in a more cost effective way by piping it under their <br />proposed addition. <br />O'Keefe inquired if the City would be maintaining a utility easement. Gundlach replied <br />that the City attorney has stated that we currently have that right, and by doing the partial <br />vacation the city retain its right to keep the utilities and maintain them. She added that <br />the reason that the City needs to maintain access to the utilities is because 2044 Old Hwy <br />8 is connected at the main sewer line and the Engineering policy states the city needs to <br />be able to maintain the line in such cases. If the building was not connected at the main <br />sewer line the whole road including the utilities could be vacated. O'Keefe inquired if <br />the easement would appear on the plat. Gundlach replied that it would appear as an <br />easement. <br />Carol Tilden, 2044 Old Hwy 8, inquired about run off that may go towards there <br />building. Wells replied that all run off goes towards the Cheetah Precision property and <br />would continue to drain in that direction. <br />Motion by Baker, Second by Zisla to CLOSE THE PUBLIC HEARING. <br />7 ayes, 0 nays MOTION CARRIED. <br />Motion by O'Brien, Second by SGhiferl to RECOMMENDING APPROVAL OF VA2007-Oa1 <br />SUBJECT TO THE FOLLOWING: <br />1. Submission of a signed Shared Access Agreement between 2044 Old Highway 8 <br />NW and Cheetah Precision. <br />7 ayes, 0 nays MOTION CARRIED. <br />Announcements: Baker stated that the Commission needs to vote for a Vice Chair. <br />O'Brien was asked if he was interested in staying as the vice chair. He declined the offer <br />and opened the position up for the other Commissioners.
