JOINT POWERS AGREEMENT <br />RELATING TO <br />MAINTENANCE AND OPERATION <br />OF LONG LAKE/RUSH LAKE REGIONAL PARK <br />This agreement is made this 1 ltn day of Ma 198 2 between <br />the County of Ramsey,. State of Minnesota (County and City of New Brighton, <br />County of Ramsey, State of Minnesota (City). This agreement is entered into <br />pursuant to Minnesota Statutes Section 471.59 (1980). <br />Whereas, portions of Long Lake/Rush Lake Regional Park are currently owned <br />by .the County, and other portions are are currently owned by the City, and - <br />Whereas, both parties recognize the regional significance of the Long Lake/ <br />Rush Lake. parks, and <br />Whereas, the County has been designated "implementing agency" to the. <br />Metropolitan Council for Long Lake/Rush Lake Regional Park, and <br />Whereas, the County and City are engaged in negotiations to rectify the <br />problems created by dual ownership of Long Lake/Rush Lake Regional Park, and <br />Whereas, both parties recognize that the uncertainty of funding of main- <br />tenance and operation costs of the regional park has been an impediment to <br />these negotiations and also to development of the park,. <br />The County and City hereby enter into this agreement regarding operation <br />and maintenance costs for the purposes of expediting the development of Long <br />Lake/Rush Lake Regional Park and easing .the problems created by dual ownership <br />of the-park, and hereby agree as follows: <br />1. The City shall, at its sole expense, provide the maintenance <br />and operation services listed below: <br />a. The City shall provide police services and the attendant- <br />attorney services necessary for prosecution of misdemeanors <br />fore the entire Long Lake/Rush Lake Regional Park. <br />b. The City shall provide fire protection services for the <br />entire Long Lake/Rush Lake Regional Park.. <br />c. The City shall continue to conduct a public beach operation <br />on Long Lake and be wholly responsible therefore. The <br />beach operation includes, but is not limited to, mai.~itenance <br />of the beach area, provision of lifeguards, and operation <br />of concession stands or clubhouse facilities, if any... <br />Any. receipts obtained by the City for such concession <br />.stands or clubhouse facilities may be retained by the City. <br />d. The City shah operate and maintain the areas designated <br />for boat launching to include both motorized. and non-motorized <br />boat launch areas. <br />
