LeFevere C1ty Of New Brighton
erbert P. Lefler III
ffrey J. Strand
aryl. Bjorklund Dear Jlm:
hn G. Kressel
ayle Nolan
inay L Lavorato
On May 17, 1983, a hearing was held in Ramsey
ichaelA.Nash COUnty District Court before the Honorable Charles A.
ke R. Komarek Flinn, Jr. to consider the motion of the Improvement
an N. Ericksen
Ifzabetn D. Moran
Association for summary judgment. In a motion for
rian F. Rice summary judgment, the party seeking summary judgment
rrame s. ciugg must. allege and demonstrate that there are no material
mes J. Thomson; Jr.
.facts in dispute .and that they are entitled to judgment
as a matter of law. The demonstration that there are
no material facts in dispute is typically made by
affidavit. In this case, the plaintiffs submitted a
number of affidavits and requested that the Court
.invalidate and rescind the transfer of the Long Lake
Park site to Ramsey County. The City .and Ramsey County
both submitted affidavits and. memoranda in opposition
to the motion for summary judgment. Additionally, we
requested that summary judgment be granted in favor of
defendants.
If summary judgment were granted for the plaintiffs,
the Court would enter an order invalidating the sale
and requiring that money paid by Ramsey County be
returned to the County. If this were to happen, I
-would recommend to the Council that I be authorized to
proceed with an appeal to the Supreme Court. This
recommendation would be based upon my opinion that the
City has not acted unlawfully in transferring the land
to Ramsey County..
