In a motion for <br />summary judgment, the party seeking summary judgment <br />must allege and demonstrate that there are no material <br />facts in dispute and that they are entitled to judgment <br />as a matter of law. The demonstration that there are <br />no material facts in dispute is typically made by <br />affidavit. In this case, the plaintiffs submitted a <br />number of affidavits and requested that the Court <br />invalidate and rescind the transfer of the Long-Lake <br />Park site to Ramsey County. The City and Ramsey County <br />both submitted affidavits and memoranda in opposition. <br />to the motion for summary judgment. Additionally, we <br />requested that summary judgment be granted in favor of <br />defendants . <br />If summary judgment were granted for the plaintiffs, <br />the Court would enter an order invalidating the sale <br />and requiring that money paid by Ramsey County be <br />returned to the County. If this were to happen, I <br />would recommend to the Council that I be authorized to <br />proceed with an appeal to the Supreme Court. This <br />recommendation would be based upon my opinion that the <br />City has not acted unlawfully in ransferring the land <br />to Ramsey County. <br />
