1. "Owner/Manager will insure that all interior and exterior lighting on the property is <br />operational" (facsimile from Seltz 11/07). As previously stated, interior and exterior <br />lighting was found inoperative on 21 February 2007. Also on the same date, Spartan <br />Protection owner Don Roggenbauer stated that they were still working on evaluating <br />the exterior lighting. <br />2. "Owner/Manager will update the access door keys in the 911 box at each building" <br />(facsimile from Seltz 11/07). As of 21 February, the 911 box is still missing from <br />2160. Further, Public Safety received only one key on 3 February to be placed in all <br />four buildings. <br />3. "Owner/Manager will replace broken windows and screens on the ground floor <br />apartments" (facsimile from Seltz 11/07). In addition to the broken window at 2160 <br />#101, on 21 February officers found screens removed from other units at 2130 west <br />side and 2160 east side. <br />4. "Place two Spartan Protection Protective Agents as residents at Timber Crest" <br />(facsimile fram Spartan 10/20): In •conversation with owner Don Roggenbauer on <br />21 February, this never came to fruition due to the cockroach problem at the <br />property. <br />5. "Establish a parking policy" (facsimile from Spartan 10/20). No evidence was <br />found to support the existence of such a program. Further, Mr. Roggenbauer <br />confirmed in his conversation that this has not yet been accomplished. <br />6. "In addition signs with the basic rules printed on them will be posted at each <br />driveway entrance and in various areas" (facsimile from Spartan 10/20). No such <br />signs existed as of 21 February. <br />7. "Visitor vehicles will be required to be parked in specific Visitor parking spaces <br />which will be marked by signs reading visitor parking only" (facsimile from Spartan <br />10/20). No such areas were posted as of 21 February. <br />8. "Housekeeping" (10/27 Timber Crest Rules & Regulations) outlines <br />tenants/resident/lessee responsibility for cleanliness of the property. None of the <br />monthly reports received to date document any efforts to enforce the housekeeping <br />provisions through violation notices. On 21 February, items were found in common <br />hallways, stairwells, laundry rooms and the exterior areas of the property that <br />constitute violations of this section. While some could likely be attributed to <br />residents, others appeared to be maintenance items (i.e., stepladder, construction <br />lumber, etc.). <br />9. "Parking "(10/27 Timber Crest Rules & Regulations) prohibits storage of vehicles. <br />Na claims of enforcement of this section have appeared in the monthly reports and <br />several snow-covered and apparently inoperative vehicles (i.e., expired tabs, deflated <br />tixe, etc.) were found parked throughout the property on 21 February. <br />10. As of 28 February 2006, Mr. Khan and Mr. Roggenbauer have both informed New <br />Brighton Public Safety that they have terminated their working relationship for <br />Spartan Protection to provide protective agents at Timber Crest Apartments. As a <br />result, Mr. Khan stated that Penrod Lane LLC will be reverting to the language of <br />their original lease documents concerning rules and regulations far the property. In <br />essence, Mr. Khan has eliminated the approved mitigation plan without consent <br />from the City. <br />D <br />Licensee has committed the following additional violations of City Cade, Chapter 13 in <br />violation of City Code, Section 13-164(1)E.: <br />:74v2 CLL NE136-205 <br />
