Council Meeting Minutes Page 3 <br />August 9, 1994 <br />Council Business. continued <br />Samuelson said one concern brought up at the Planning Commission was that if the <br />rezoning was approved, there is a possibility that a ownership or business use <br />change may occur. She feels there is no guarantee that an ownership change would <br />not occur, however, the building's design somewhat limits other business uses. <br />Mattila said a B-1 District allows for office or dental businesses, and disallows gas <br />stations or other high traffic type uses. He feels this proposal appears to he the best <br />use of a B-1 District. <br />Berke noted the location of air conditioning units on the 10th St. side, and asked if <br />they could present a noise concern to adjacent properties. Mattila said the applicant <br />proposes to provide landscaping near the units; and those neighbors to the east did <br />not feel the location of the units were a problem. <br />Williams noted that the building's square footage appears to be 10% of the total lot <br />size and is really not much larger than a good sized home. <br />Jim Strapco, Architect, said the property owner to the east was contacted and <br />requested the air conditioning units be moved further south. These units are similar <br />to those used in homes and are much quieter than commercial units. <br />Samuelson said previous attempts to locate a tenant for the site has been difficult, <br />and noted support for the project because it is an excellent use for that site. <br />Williams agrees the structure's design fits in with the neighboring properties. <br />Dr: Jalali attempted to design a building which would blend in well with the <br />neighboring properties. He is very anxious to begin construction and the facility <br />should open by the end of this year or early next year. <br />Berke feels this proposal provides a positive and acceptable addition to that corner. <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING, HOLD <br />THE FIRST AND SECOND READING, AND ORDER THE PUBLICATION <br />OF AN ORDINANCE AMENDING THE NEW BRIGHTON ZONING <br />ORDINANCE TO REZONE CERTAIN PROPERTY FROM R-3B, MULTIPLE <br />FAMILY RESIDENTIAL TO B-1, LIMITED BUSINESS, SUBJECT TO THE <br />FOLLOWING CONDITION: <br />1. APPROVAL OF LP-291 AND VN-298; <br />AND WAIVE THE READING AND ADOPT THE RESOLUTION <br />APPROVING VN-298; AND APPROVE LP-291, SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />1. CITY ENGINEER AND RICE CREEK WATERSHED DISTRICT <br />APPROVAL OF GRADING AND. DRAINAGE PLAN. <br />2. PROVIDE CITY WITH A LETTER OF CREDIT OR BOND <br />COVERING 100% OF THE COST TO INSTALL CURBING, <br />BITUMINOUS SURFACE AND LANDSCAPING. <br />3. PROVIDE CITY WITH A PROOF OF PARKING AGREEMENT TO <br />COVER 9 ADDITIONAL PARKING STALLS. <br />4.
