<br />RESOLUTION NO 84-52 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN AMENDMENT TO SPECIAL USE <br />PERMIT, SP-78 <br /> <br />~_:Ir <br /> <br />WHEREAS, an application for a special use permit has been made by the Rice <br />Creek Shopping Center for property described as: <br /> <br />Lot 2, Block 1, Rice Creek Plaza <br />Ramsey County, Minnesota <br /> <br />and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for an amendment to SP-78 was filed with the City on' <br />Ma rch 14, 1 984. <br />2. That the applicant requested that the public hearing date be held in <br />Apri 1 . <br />3. That the Planning Commission, pursuant to published and mailed notices, i <br />held a public hearing on April 17, 1984, all persons present at the <br />hearing were given an opportunity to be heard. <br />4. That the application for an amendment to SP-78 was reviewed by the City <br />Council on April 24, 1984. <br />5. That the comments and analysis of staff and the Planning Commission <br />minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED that the City Council makes the following <br />Findings of Fact in respect to amending SP-78: <br /> <br />1. That the Shopping Center is an area of special control which merits <br />special signing consideration. <br />2. That the shape of the shopping center does not make tenant wall signs <br />easily visible from Silver Lake Road. <br />3. That the need for a ground sign listing the names of the Shopping Center <br />tenants has been expressed as an ongoing need by the shopping center <br />management, past and present. <br />4. That the overall area and height of the ground sign, as indicated in th~ <br />shopping center sign plan, will not be increased. <br /> <br />BE IT FURTHER RESOLVED that the application for an amendment to SP-78 is <br />hereby approved subject to the following conditions: <br /> <br />1. That the following item of the sign plan approved on December 27,1977 <br />be amended under Section IIGround Signsll to read: <br /> <br />1. The Center shall be identified by a single ground sign with an <br />overall area of 104 square feet. As shown on Exhibit H-l the sign <br />shall have an 8 foot x 1 foot 4 inch panel stating IIRice Creek <br />Centerll, an 8 foot x 11 foot 6 inch copy board with 20....3 foot 6 inch <br />x 1 foot tenant 1.0. spaces per side, a 6 foot 9 inch pole, a 1 foot <br />5 inch high brick planter and a 2 foot IIshingle-type topll. The <br />overall height of the sign shall be 23 feet 2 inches. <br /> <br />Such ground sign shall be located north of the southernmost driveway <br />a distance of no more than fifteen (15) feet to Rice Creek Center <br />and shall be set back a minimum of ten (10) feet from Silver Lake <br />Road. <br /> <br />2.
