""" <br /> <br />RESOLUTION NO 84-48 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF <br />A PORTION OF 8TH AVENUE NW <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That Robert L. Christen and Donnelly Electric Company <br />submitted a petition, as over fifty percent of the <br />property owners involved, to vacate a portion of 14th <br />Avenue. <br />2. That the City Council. pursuant to published notices. <br />held a pUblic hearing on the vacation, all persons <br />present at the hearing were given an opportunity to be <br />h ea rd. <br />3. The written comments of the City staff were considered. <br /> <br />WHEREAS, the request is to vacate a portion of 8th Avenue NW <br />described as follows: <br /> <br />All that part of 8th Avenue NW lying south of Old Highway <br />#8 and north of 1st Street NW. A drainage and utility <br />easement shall be retained over the entire area. <br /> <br />WHEREAS, upon vacation of the above described public right- <br />of-way public interest in the property will accrue to the follow- <br />ing described abbuting properties: <br /> <br />1. The North i of the South i of the Southeast 1 of the <br />Southwest! of Section 29, Township 30, Range 23, <br />except that part West of United States Highway No.8 <br />and that part taken for said United States Highway No.8. <br /> <br />That part of the North i of the Southeast t of the <br />Southwest t of Section 29~ Township 30, Range 23, lying <br />Easterly of State Trunk Highway No.8 subject to the <br />part taken for Long Lake Road. <br /> <br />2. Parcell. That part of Block 6, New Brighton~ and that <br />part of adjoining Third Street Northwest, vacated, all <br />described as beginning at the Southwest corner of said <br />Block 6; thence North along the West line of said Block 6 <br />and its extension to an intersection with a line parallel <br />to and 10 feet South from the North line of said Third <br />Street Northwest as shown on said plat; thence East along <br />said parallel line to an intersection with a line parallel <br />to and 446.5 feet East from said West line of Block 6 and <br />its extension; thence North along said last described <br />parallel line 10 feet to an intersection with said North <br />line of Third Street Northwest; thence East along said <br />North line to a point thereon 599 feet East from the <br />intersection of said North line with the extension <br />Northerly of said West line of Block 6; thence South, <br />parallel to said West line of Block 6 and its extension, <br />849.69 feet; thence Southwesterly to a point on the <br />South line of said Block 6 distant 559 feet East from the <br />point of beginning; thence West to the point of beginning. <br /> <br />Parcel 2. That part of Block 6, New Brighton, and that <br />part of adjoining Third Street Northwest, vacated, all <br />described as beginning at a point on the South line of <br />said Block 6 distant 769 feet East from the Southwest <br />corner of said Block 6; thence North, parallel to the <br />West line of said Block 6 and its extension, to the North <br />line of said Third Street Northwest as shown on said plat; <br />thence East along said North line to an intersection with <br />the extension North of the East line of said Block 6, <br />thence South along said East line and its extension to <br />the Southeast corner of said Block 6; thence West to the <br />point of beginning. <br /> <br />Parcel 3. The East 50 feet of the West 529.5 feet of the <br />South 100 feet of the Northwest Quarter of the Southeast <br />Quarter of Section 29, Township 30, Range 23. <br />
