<br />RESOLUTION NO. 84-44 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY <br />PRD-38 AND PRELIMINARY PLAT PL-136. <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for preliminary PRD-38 and <br />preliminary plat Pl-l36 was filed with the City of <br />New Brighton on February 6, 1984. <br />2. That the Planning Commission. pursuant to published <br />and mailed notices, held a public hearing on the <br />preliminary PRD-38 on March 28, 1984. All persons <br />present at the hearing were given an opportunity to <br />be heard. <br />3. That such application was reviewed by the City Council <br />on April 10, 1984. <br />4. The written comments and analysis of the City Staff and <br />the Planning Commission minutes and recommendation were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED that the New Brighton City <br />Council makes the following Findings of Fact in respect to PRD-38 <br />and PL-136. <br /> <br />l. That the property is zoned R-l, Single Family Residential <br />and R~2, Two Family Residential. <br />2, That the preliminary plat is consistent with the sub- <br />division regulation contained in Chapter 26 of the City <br />Code. <br />3. That the proposal is consistent with the stated purpose <br />and principles of the PRO provisions as contained in <br />Section 7-010. <br />4. That the PRO is consistent with the existing zoning and <br />goals of the City Comprehensive Plan. <br />5. That the proposed development is compatible with the <br />type, density and bulk of surrounding lands. <br /> <br />BE IT FURTHER RESOLVED, that the applications for PRD-38 and <br />PL-l36 are approved subject to the following conditions: <br /> <br />1. That the association covenants and declarations be <br />reviewed and approved by the City Attorney. <br />2. That final PRD plans include a complete and dimensioned <br />site and landscape plan and front, side and rear building <br />elevations. <br />3. That the applicant develop a unit design which better <br />reflects the high quality of development already existing <br />adjacent to the site. <br />4. Inasmuch as the plans and design adverted to in paragraphs <br />two and three above have not yet been presented to the <br />Council and the suitability of the proposed development <br />will depend upon the information contained in said plans <br />and designs, the Council specifically reserves the right <br />to refuse to grant PRD and final plat approval if it <br />determines, in its sole discretion, that the final pro- <br />posed landscaped plan, exterior design and materials, <br />grading plan, and unit design do not provide adequate <br />protection to the residential character of the adjacent <br />property to the north of the subject property. <br /> <br />Adop!~d--t1F~s~10th day of April <br /> <br />~ 1984. <br /> <br />AT U S T : -;:~ --' ' <br /> <br />,,,.,...... <br /> <br />"". <br /> <br /> <br />-. ,. ~ ..,,-'- <br /> <br /> <br />E g an, City C 1 e r k <br /> <br />(SEAL) <br />
