<br />"- <br /> <br />'"" <br /> <br />RESOLUTION NO 84-43 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING VARIANCE VN-231 <br /> <br />WHEREAS. an application for VN-231 has been made by Remington <br />Builders for the property described as: <br /> <br />Lot 5, Block 1, Innsbruck North Silver Lake Addition <br />Ramsey County, Minnesota; <br /> <br />to allow less than the required front yard setback; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />l. That an application for a variance VN-23l was filed with <br />the City on March 6, 1983. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on March 28, 1984, <br />and all persons present at the hearing were given an <br />opportunity to be heard, <br />3. That such application was reviewed by the City Council <br />on April lO, 1984. <br />4. The written comments and analysis of the City staff and <br />the Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-231: <br /> <br />l. That the property is zoned R-l, Single Family Residential; <br />2. That the required front yard and side street yard setbacks <br />in R-l zoning districts is 30 feet; <br />3. That the area may have been platted with a misunderstanding <br />on the setback requirements on the cul-de-sac; <br />4. That the configuration of the cul-de-sac is A-sysmetrical <br />and is not similar to other cul-de-sacs in the City; <br />5. That there are only three points of the proposed dwelling <br />that protrude into the setback area~8 and 10 feet; <br />6. That the proposed home is of comparable size and value of <br />the surrounding area; and <br />7. That the applicant has demonstrated unique and unusual <br />circumstances and undue hardship for the variance. <br /> <br />BE IT FURTHER RESOLVED, that the application for VN-23l is <br />and hereby approved. <br /> <br />Adopted this lOth day of April, 1984. <br /> <br />~t1~ <br /> <br />ATTEST: <br /> <br /> <br />~ <br />Marga_ e-t~A.
