<br />.... <br /> <br />.! <br /> <br />,,. <br /> <br />~ <br /> <br />RESOLUTION NO. 84-41 <br />STATE, OFMINNESOT A <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />! <br /> <br />II <br />I RESOLUTION MAKING FINDINGS OF FACT <br />USE PERMIT~ NC-60. <br /> <br />AND APPROVING NON-CONFORMING <br /> <br />WHEREAS, an application for a non-conforming use permit, <br />Ne-60, has been made by the City of New Brighton to allow expan- <br />II sion of the New Brighton Fire Station on a site with Type IV non- <br />! conformities; and <br /> <br />WHEREAS, the proced~ral history of the application is as <br />follows: <br /> <br />Ii <br />I <br />I <br />I <br />! <br /> <br />, <br />i <br />I <br />I <br />I <br /> <br />I <br />1-" <br /> <br />1. That a request for a non-conforming use permit. NC-60, <br />has been made by the City of New Brighton. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on March 28, 1984. <br />and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. That the application for NC-60 was reviewed by the City <br />Council on April 10, 1984. <br />4. That the comments and analysis of staff and the Planning <br />Commission minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to NC-60. <br /> <br />1. That the site is zoned B-4, Downtown Business District. <br />2. That Section 5-350 (d) states that commercial and <br />industrial uses within the downtown redevelopment <br />district shall corl'l\)Jywith all developmentregul ati ons <br />applicable in the B-3, General Business district. <br />3. That the site has the following Type IV non-conformities <br />under a B-3, General Business zoning: <br />A. Less than a 30 foot side street yard setback; <br />B. Less than a 30 foot rear yard setback, <br />C. Less than a 25 foot landscaped buffer between the <br />fire station property and abutting R-l zoned <br />properties. <br />D. Less than the required parking. <br />E. Greater than a 36 foot wide driveway. <br />F. Height of the water tower. <br />4. That unique and unusual circumstances do exist and that <br />undue hardship would result if the non-conforming use <br />variance as stated in Section 8-460 (d) were not granted <br />5.
