<br />~ '--' <br /> <br />l'~ <br /> <br />'-~ <br /> <br />RESOLUTION NO 84-37 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF <br />A PORTION OF 14TH AVENUE NW <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That Gordon Hedlund submitted a petition, as fifty per- <br />cent of the property owners involved, to vacate a <br />portion of l4th Avenue. <br />2. That the City Council, pursuant to published notices, <br />held a public hearing on the vacation, all persons <br />present at the hearing were given an opportunity to be <br />h ea rd. <br />3. The written comments of the City staff were considered. <br /> <br />WHEREAS, the request is to vacate a portion of 14th Avenue <br />NW described as the north 198.41 feet of 14TH Avenue NW lying <br />south of 7th Street. <br /> <br />WHEREAS~ upon vacation of the above described public right- <br />fo-way, public interest in the property will accrue to the <br />following described abutting properties: <br /> <br />1. Lots 1-5, Block 7, Syndicate Addition to Minneapolis <br />Stockyards, Ramsey County, Minnesota. <br />2. Lots 26-30, Block 6, Syndicate Addition to Minneapolis <br />Stockyards, Ramsey County, Minnesota. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council hereby finds that it is in the public interest to vacate <br />the above described public right-of~way and makes the following <br />Findings of Fact: <br /> <br />1. That the portion of 14th Avenue NW to be vacated is <br />unimproved and does not serve a public purpose. <br />2. That there are no utilities within that portion of <br />right-of-way. <br />3, That there appears to be no need for the right-of-way <br />in terms of future street improvements. <br /> <br />BE IT FURTHER RESOLVED, that a portion of 14th Avenue NW <br />described above is hereby vacated subject to the following <br />conditions: <br /> <br />1.
