<br />'-' <br /> <br />RESOLUTION NO 83-124 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE <br />PERMIT, SP-1l6 <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-116 has been made by Stony Lake Office Park for the property <br />described as: <br /> <br />Lot 9, Except the South 50 feet; <br />Lot 10 to 14 Inclusive, in Block 1, <br />Pike Lake Estates, Ramsey County; <br /> <br />to permit an eight foot fence; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for Special Use Permit SP-116 was <br />filed with the City of New Brighton on October 4, 1983. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on October 18, 1983 <br />all persons present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City Council on <br />October 25, 1983. <br />4. The written comments and analysis of the City staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to SP-116: <br /> <br />1. That an eight foot fence is needed to more substantially <br />buffer Stony Lake Office Park from the adjacent alley <br />and shopping center. <br />2. That an eight foot fence will not negatively impact the <br />adjacent property, restrict further development, or <br />prevent the free flow of air. <br />3. That an eight foot fence is consistent with the purpose <br />for the regulation of fences, Section 4-540(a). <br /> <br />BE IT FURTHER RESOLVED, that the application SP-116 is <br />hereby approved subject to the following conditions: <br /> <br />1. That the fence shall not extend beyond the west wall of <br />the southwest office buidling so as not to obstruct the <br />visibility of carS pulling in and out of the shopping <br />center. <br />2.
