<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 11, 1986 <br /> <br />Brandt agreed it was not the variance the developer is seeking <br />that creates the intrusion, but the rezoning; the only difference <br />the variance is going to make is an economical difference of <br />having another floor for renting to clients and that is not a <br />permissable hardship when the only distinction is the amount of <br />income that would be generated whether or not the variance was <br />granted. Brandt stated that, technically, she did not see how <br />she could find the project was subject to an undue hardship which <br />requires the variance to be granted; if the variance is not <br />granted, a building still can be built. <br /> <br />3 Ayes - 2 Nayes (Brandt, Gunderman), Motion Failed [adoption of <br />a variance requires 4 votes] <br /> <br />In response to Winkels question, LeFevere responded there was no <br />further action the council could take. <br /> <br />Benke stated he appreciated the patience of the applicant, devel- <br />oper, staff, and neighbors; the presentations were excellent, the <br />facts were on the table, a decision has been made. <br /> <br />Kelley had nothing to add to the staff report concerning a <br />gambling license application by the Tri-City American Legion. <br /> <br />As there were no comments from the applicant, motion by Benke, <br />seconded by Brandt, to APPROVE THE GRANTING OF A GAMBLING <br />LICENSE TO THE TRI-CITY AMERICAN LEGION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Krueger had nothing to add to the staff report concerning ordin- <br />ance amendments pertaining to elderly and elderly housing. <br /> <br />Motion by Williams, seconded by Gunderman, to WAIVE THE READING, <br />HOLD THE SECOND READING, AND ORDER PUBLICATION OF ORDINANCE <br />AMENDMENTS TO THE NEW BRIGHTON ZONING CODE BY DELETING THE REFER- <br />ENCE TO SUBSIDIZED IN SECTION 7-060{g)(4), DELETING THE DEFINI- <br />TION OF SUBSIDIZED HOUSING, CREATING A DEFINITION OF ELDERLY <br />HOUSING AND AMENDING THE CURRENT DEFINITION OF AN ELDERLY PERSON. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Sinda had nothing further to add to the staff report concerning a <br />Municipal Amicus Program. <br /> <br />Motion by Benke, seconded by Brandt, THAT THE CITY OF NEW BRIGHTON <br />PARTICIPATES IN AN LMC MUNICIPAL AMICUS PROGRAM. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Page Seventeen <br /> <br />Gambling License <br />- American Legion <br />Report 86-32 <br /> <br />Ordinance Amendments <br />Elderly and Elderly <br />Housing <br />Report 86-32A <br />Ordinance 538 <br /> <br />Municipal Amicus <br />Program <br />Report 86-33 <br />
