<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 27, 1986 <br /> <br />Council Business, continued <br /> <br />Motion by Schmidt, seconded by Williams, to WAIVE THE READING AND <br />ADOPT A RESOLUTION ACCEPTING THE FEASIBILITY STUDY, AND ORDERING <br />PROJECT 86-10 AND THE PREPARATION OF CONSTRUCTION PLANS AND <br />SPECIFICATIONS; and to AUTHORIZE THE USE OF ORR-SCHELEN-MAYERON <br />AND ASSOCIATES TO PROIVDE ENGINEERING SERVICES FOR THE PROJECT. <br /> <br />Mills asked if the levying could be done earlier, even though it <br />would not be effective until 1988, giving Pratt Homes the <br />opportunity to market the lots earlier and at a faster rate. <br /> <br />LeFevere stated the Agreement is a waiver up to a total of <br />project cost; it would be possible to levy assessments based on <br />the estimated costs; but it may be a disadvantage to the Seminary. <br /> <br />Proper stated assessments would have to be made on an estimated <br />basis and then reassessment the project; and doesn't see that that <br />would alleviate the problem; if something is assessed on an <br />estimated basis, normally the City includes a contingency to <br />protect itself and might end up paying five percent more than <br />necessary. <br /> <br />Benke asked if we collected that five percent up front if we <br />would refund it to those that had paid; Proper indicated there <br />may be a way to adjust the money at a later date. <br /> <br />(Gunderman returned - 9:26 p.m.) <br /> <br />LeFevere stated he was not sure anyone would object to that and <br />such action could be taken at any time with no notice; and, if <br />the city is comfortable with proceeding on an estimated basis, <br />assessments could be levied at the next meeting; Benke sought a <br />contingency in the event the estimate is low. <br /> <br />Mills asked that this question be kept open and, after the <br />contracts are let, the Seminary be able to come back and ask for <br />a session for a notice at an earlier date than might otherwise <br />be proposed; Benke stated that we would hold the hearing in <br />August of 1987 if the City did not hear back from the Seminary. <br /> <br />LeFevere stated the assessments could be levied at the same time <br />so they could all go into the County together, even though it <br />could be done at any time. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Page Thirteen <br />
