Setback Exemptions; Section 2-620. Definition of
Structure; and Section 2-621. Definition of Principal Structure. He
stated the ordinance is an attempt to clarify the zoning code in
regard to decks. Mr. Winkels reminded the Council that a few
months ago a situation arose regarding a deck and this ordinance
will clarify what the setbacks are. This ordinance amendment does
in fact make it clear that decks are subject to the district setback
requirements which have always applied in this city. The ordinance
itself has been reviewed by the Planning Commission and they are in
full agreement with the recommendation.

Harcus stated that it seems to improve the current ordinance and
he was Council Representative on the Planning Commission when the
problem with the deck came to light and he feels the only way we
are going to find out how the ordinance will work is when the first
request is processed.

Winkels felt there never seemed to be a problem with the existing
ordinance but feels this amendment will definitely improve it.

Motion by Harcus. seconded by Blomquist. to WAIVE THE READING AND
HOLD THE FIRST READING OF ORDINANCES At1ENDING SECTION 2-620.
