<br />RESOLUTION NO 83-112 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-227 <br /> <br />- '-" <br /> <br />~'! ,~ <br /> <br />WHEREAS, an application for VN-227 has been made by Mateffy <br />Engineering for property described as: <br /> <br />The South 120 feet of the North 502.5 feet of the East 200 <br />feet of that part of the Southwest i of the Northeast i of <br />Section 29j Township 30, Range 23, lying West railroad right- <br />of-way line of the Minnesota Belt Line Railway, and also the <br />East 200 feet of all that part of the Southwest i of the <br />Northeast! of said section lying West of the West right-of- <br />way line of the Minnesota Belt Line Railway, except the North <br />502.5 feet thereof and except the South 700 feet thereof, <br />together with an easement for ingress and egress thereto and <br />therefrom over and across the Northerly 10 feet of the <br />Easterly 145 feet of all that part of the Southwest i of the <br />Northeast i of said section lying Southeasterly of State <br />Trunk Highway No.8 and Westerly of the West right-of-way <br />line of the Minnesota Belt Line Railway, except the East <br />200 feet thereof; <br /> <br />to construct a garage with a less than required setback; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a variance VN-227 was filed with <br />the City on September 5, 1983. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on September 20, <br />1983, all persons present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on September 27, 1983. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-227: <br /> <br />1. That the property is zoned B-3, General Business. <br />2. That the placement of the garage on any other location <br />on the site would severly limit use of the applicant's <br />property. <br />3. That not having a garage would create undue hardship on <br />the appl icant. <br />4. That the proposed garage will have a 10 foot setback and <br />there is a 20 foot sewer easement on the adjacent <br />property. <br />5.
