<br />" <br /> <br />",,"." ,'. <br /> <br />ORDINANCE NO. fifi 1 <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE AMENDING SECTIONS 4-1, 4~96, 4-106 AND 4-112 OF THE <br />NEW BRIGHTON CITY CODE RELATING TO THE SALE OF ALCOHOLIC <br />BEVERAGES <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON DOES ORDAIN: <br /> <br />SECTION 1: Article I, Section 4-1 of the New Brighton City Code is hereby amended by amending <br />the definition of restaurant as follows: <br /> <br />Section 4-1. Definitions. <br /> <br />Restaurant: Any establishment, other than hotel or motel, under the control of a single <br />proprietor or manager, having appropriate facilities to serve meals and for seating not less than one <br />hundred twenty-five (1251 guests at one time, or fortv (40) Quests in the case ofbrewnubs and where <br />in consideration of payment therefor, meals are regularly served at tables to the general public, and <br />which employs an adequate staffto provide usual and suitable service to its guests, and the principal <br />part of the business of which is the serving of food. Brewoubs are restaurants at which beer is <br />brewed or manufactured for sale on the oremises in coni unction with the sale of food and at which <br />no alcoholic beveraQes other than beer and wine are sold. <br /> <br />SECTION 2: Article V, Section 4-96 paragraph (1) is hereby amended to read as follows: <br /> <br />Section 4-96. Sunday Liquor Sales. <br /> <br />(1) Notwithstanding the provisions of section 4-95, establishments to which "on-sale" <br />licenses have issued or hereafter may be issued for the sale of intoxicating liquors which are hotels, <br />motels, restaurants, or clubs which have facilities for serving not less than fifty (50) guests at one <br />time, or forty (40) guests in the case ofbrewpubs. may serve intoxicating liquors between the hours <br />of 10:00 a.m. and 12:00 midnight on Sunday in conjunction with the serving of food. <br /> <br />SECTION 3: Section 4-106 is hereby amended to read as follows: <br /> <br />Section 4-106. Categories. <br /> <br />There shall be [four (4)] five (5) categories of "on sale" liquor licenses authorized to be <br />issued by the city. <br />
