The city lacks an adequate number of moderate to upper-level income apartment <br />units. <br /> <br />1.05. The Livable Communities Documentation indicates that: <br /> <br />a. The city exceeds its goal for affordable rental housing, but does not meet its goal <br />for affordable owner-occupied housing under the Livable Communities Act. <br /> <br />b. The city's owner to renter ratio is lower than its goal under the Livable <br />Communities Act. <br /> <br />1.06. The Coalition is engaged in discussions about how best to plan and distribute <br />transportation services and other amenities, housing, industry, and commerce among the <br />. member cities. <br /> <br />1.07. City staff and residents have raised concerns about the effect on the city's abilities <br />to meet its housing goals if additional multi-family housing is constructed before adequate <br />studies are conducted and appropriate zoning changes are considered. <br /> <br />1.08. The city must proceed further with planning and study before it can determine the <br />appropriate mix of owner-occupied and rental units within the city's housing stock, the most <br />. desirous locations for new multi-family housing within the city, and the most efficient <br />,transportation and other facilities to serve residents of the city. <br /> <br />1.09. The council has determined that there is a need for further studies to be conducted <br />so that the city may consider appropriate amendments to its comprehensive plan and zoning <br />code so as to ensure protection of the public, health, safety and welfare. The council has <br />. directed that such studies be undertaken. <br /> <br />. 1.10. Due to the potential for new construction of multi~family units during the time studies <br />are being undertaken, the council has determined that there is a need for an interim ordinance <br />to be adopted pursuant to Minnesota Statues, Section 462.355, Subd. 4, for the purpose of <br />protecting the planning process and the health, safety and welfare of the citizens of the city, <br />and ensuring that the city and its citizens retain the benefits of, and the protection sought to <br />be afforded by, the city's comprehensive plan and zoning ordinances until the study process <br />is complete and any modifications to the city's comprehensive plan and zoning ordinance <br />become effective. <br /> <br />Section 2. Properties Subiect to Moratorium. <br />2.01. All property within the city is subject to the provisions of this moratorium. <br />Section 3. Prohibition. <br /> <br />3.01. During the period this interim ordinance is in effect, no "multiple-family dwelling" <br />(as defined by the city's zoning code) may be constructed or developed, and no site plan <br />approvals, rezonings, licenses (other than renewals), plattings or replattings, land divisions <br />or consolidations, special use permits, or building permits will be considered, approved, or <br />granted by the city for the purpose of constructing or developing such a multiple-family <br /> <br />2 <br /> <br />I:\SHARED\COUNCIL\ORDINANC\CODIFlCA\APPROVED\670.wpd <br />
