<br />h' <br /> <br />Ordinance No. 678 <br />State of Minnesota <br />County of Ramsey <br />City of New Brighton MN <br /> <br />AN ORDINANCE ADOPTING THE RECODIFICATION OF THE CITY CODE <br /> <br />The City Council of the City of New Brighton does ordain as follows: <br /> <br />Section 1. <br />1.1 <br /> <br />1.2 <br /> <br />1.3 <br /> <br />1.4 <br /> <br />Section 2. <br /> <br />2.1 <br />2.2 <br />2.3 <br />2.4 <br /> <br />2.5 <br /> <br />2.6 <br /> <br />Background <br />Minnesota Statutes, Sections 415.02,415.021 and 599.13 authorize the City <br />to codify its ordinances and print them in book or loose leaf form, and provide <br />that any ordinance included in a new code but not previously published is <br />sufficiently published if a substantial quantity of the code is printed for <br />distribution to the general public. <br />The City has completed a recodification of the Code of Ordinances of the <br />City, which was prepared in house by City staff with assistance from the City <br />Attorney, and which incorporates ordinances through Ordinance Number 677. <br />The City Council has reviewed the proposed recodification in a publication <br />called "The New Brighton City Code of 200 1". The Recodification is on file <br />with the City Finance Director/Clerk. <br />Minnesota Statutes, Section 412.191 Subdivision 4 allows publication by title <br />and summary in the case oflengthy ordinances or those containing charts or <br />maps. The Council finds: that the summary ofthe 2001 Recodification would <br />clearly inform the public ofthe intent and effect ofthe Recodification; that the <br />Recodification is lengthy, being over 450 pages in length; and that publication <br />by summary is appropriate. <br />Summary of Recodification. The recodification incorporates ordinances <br />through Ordinance No. 677 into the City's Code and makes changes that are <br />summarized as follows: <br />The entire Code has been reformatted to a uniform numbering system. <br />The text has been modified to be gender neutral. <br />References to Minnesota Statutes and Rules have been updated. <br />Various fees set by ordinance were deleted and are now to be set by Council <br />resolution. <br />In many cases the assignment of duties to specific staff positions have been <br />deleted to reflect administrative reorganizations and to allow flexibility in staff <br />duty assignments. <br />Many changes in grammar, punctuation and form have been made, not <br />affecting or altering the substances of the Code. <br />Section 15-380 increased insurance requirements for Amusement Centers to <br />$1,000,000. <br />Article 3 of Chapter 18 dealing with narcotics and drugs has been deleted as <br />obsolete. The subject is covered by State law. <br />Section 5-52 has been amended to regulate public dances and dance halls <br />because of repeal of the State law formerly incorporated by reference. <br /> <br />2.7 <br /> <br />2-8 <br /> <br />2-9 <br />
