<br />! ! <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />ORDINANCE NO. 679 <br />AN ORDINANCE RELATING TO HOUSING; <br />AMENDING NEW BRIGHTON CITY CODE CHAPTER 13 <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS as follows: <br /> <br />Section 1. New Brighton City Code is amended by adding new Section 13-1.1 as follows: <br /> <br />Sec. 13~1.1. Purpose. <br /> <br />It is the purpose ofthis Chapter to assure that rental housing in the City is decent. safe and sanitary ! <br />and is so operated and maintained as not to become a nuisance to the neighborhood or to become an I <br />influence that fosters blight and deterioration or creates a disincentive to reinvestment in the <br />community. The operation of rental residential properties is a business enterprise that entails certain <br />responsibilities. Operators are responsible to take such reasonable steps as are necessary to assure <br />that the citizens of the city who OCCUpy such units may pursue the Quiet enioyment of the normal <br />activities of life in surroundings that are: safe. secure and sanitary: free from crimes and criminal <br />activity. noise. nuisances or annovances: free from unreasonable fears about safety of persons and <br />security of property: and suitable for raising children. <br /> <br />Section 2. <br /> <br />New Brighton City Code Section 13.5 is amended as follows: <br /> <br />Sec. 13~5. Inspection of dwellings-Generally. <br /> <br />(a) The enforcement officer shall be authorized to make or cause to be made inspections to I <br />determine the condition of dwellings, multiple dwellings, dwelling units, rooming houses, rooming <br />units, and premises in order to safeguard the health, safety, morals, and welfare of the public. The <br />enforcing officer, or his the officer's designated representatives, shall be authorized to enter any <br />dwelling, dwelling unit, multiple dwelling, rooming house, or premises at any reasonable time for <br />the purpose of performing ms the officer's duties under this chapter. The owner, operator, or <br />occupant of every dwelling, multiple dwelling, dwelling unit, rooming unit, or the person in charge : <br />I thereof, shall give the enforcement officer free access to such dwelling, multiple dwelling, dwelling <br />unit, rooming unit on which it is located at all reasonable times for the purpose of such inspection, I <br />examination and survey. Ifthe owner, operator, or person in charge thereof shall refuse to consent <br />to the inspection, the "(,1 t;fic.atG of Ic'gistlAtion license shall be revoked. If the occupant refuses to <br />consent to the inspection a search warrant may be obtained. <br /> <br />(1) Where there is probable cause to believe a violation exists within the particular <br />structure; or <br /> <br />(b) <br /> <br />(2) Where a determination has been made to conduct periodic inspections of certain <br />areas of the city. <br />I <br />No warrant is needed for entry where an emergency condition exists which endangers; <br />persons or property and insufficient time as is available to obtain a warrant and protect such ; <br />endangered persons or property. <br /> <br />Entry under this section is subiect to Minnesota Statutes.
