<br />WHEREAS~ City Code Chapter 24 entitled Sewer Department
<br />Regulations and Chapter 15, Article VII, entitled Offensive
<br />Trad~s, and Metropolitan S~wer Board Rules and Requlationsfor
<br />the Metropolita~ Disposal System and the Minnesot~ Pollution
<br />Control A~ency Standards all apply to the ope(ation_of
<br />ii' Mengelkoch Company as a rendering business; and '

<br />WHEREAS, the City is aware and has been informed that c~rtain
<br />deficiencies in the operation of the Mengelkoch Co~pany have
<br />occurred in the past with respect to these codes, rules~
<br />re~ulations and standards; and
<br />

<br />WHEREAS, the deficiencies which previously exist~d in regard
<br />to disposal of sewa,gehave, in the past, affected the safety,
<br />hejlth, welfare and well-being of the City.s residents in that
<br />s~ch deficiencies cause plugging of the sanitary sewer 'arid lift
<br />station. int~rferencewith sanitary Sewer service to others,
<br />dumping of raw sewage on the op&n ground, and emission of
<br />offen s i v e 0 do"rs i n the n ei g h b 0 rho 0 d ; and

<br />Further, that/the test indicated a total -emission level of
<br />100,900 odor ~nits pe~ minute which is within the limit of one
<br />million odor units per .minu..:te,allowed by APC-9; and

<br />WHEREAS, a setond emi~9ion test ~as pe~formedon August 18,
<br />1 9 8 2 , which indicated an average odor level of 24,u nit s per
<br />cubic foot and a total:emi"s$ion level of.535,600 odor units
<br />per minute.

<br />NOW THEREFORE BE IT RESOLVED, that the Offensive Trades
<br />License of the Mengelkoch Company for the premises at 119-14th
<br />Street NE be granted under the following conditions:
<br />

<br />1. All doors and windows shall be kept closed during
<br />periods of operation so that all rendering plant
<br />air will be processed through a scrubber or burned,
<br />except during periods of loading and unloading when
<br />loading doors may be open but these periods shall
<br />be kept to a minimum.

<br />the City of ~ew Brighton dated January 25, 1977,
<br />and as amended by a subsequent agreement da.ted
